Legal Vocabs

I was encouraged to activate my blog with the purpose of sharing my insights on my subjects.  While Judge Ongkeko was telling us how we could hit two birds with one stone by having a blog  (you learn and you can help others learn as well), I started to have all these ideas about what I would publish.  In the meantime, here are some of the words which we were asked to define, and words that are not familiar to me:

1.  PRESTATION - a payment either in money or service; a performance of a duty whether or not to do something as a fulfillment of an obligation.

2.  CREDITOR - an individual or an entity to whom money is due; "pinagkakautangan"

3.  DEBTOR - an individual or an entity that is in debt to another; "may utang"

4.  OBLIGEE - an individual or entity to whom one is under obligation based on a contract or legal agreement

5.  OBLIGOR - an individual or entity that is bound to another for a certain debt or duty by means of a contract or legal agreement

4.  SALE - a transfer of property of any kind or of services in exchange for money (or anything of value) or other terms agreed and considered by both parties

5.  PLEDGE - a serious promise, commitment or agreement to do or not do something

6.  DEPOSIT - to place for safekeeping or in trust by the depositor, without any reward and which to be returned when the depositor shall require it

7.  EQUITY - under the context of obligations and contract, equity is the money value of property on top of claims, liens, or property mortgages; in its broadest definition, equity means fairness

9.  CLAIMS - a legal assertion or demand by a person who wants a payment, compensation or reimbursement for a loss under a contract or an injury caused by negligence

10.  LIENS - serves as a security for a debt or performance charge given by the debtor to the creditor; it is the creditor's qualified right over a specific property of his debtor

11.  MORTGAGES - a document expressing the owner's (mortgagor)will to pledge his/her property title to a lender (mortgagee) as security for a loan according to a promissory note

12.  ANTI-CHRESIS - an agreement between the creditor and the debtor where the latter gives the former the income from the property he/she has pledged in lieu of the interest on his/her debt

13.  SECURITY - serves as the assurance of a debt payment or a fulfillment of an obligation

The Revival

So here it is, welcome to my secret blog -- that is not so secret anymore. As you can see, my last entry was published in 2010, actually, there were a few more entries after that, only they had been reverted to drafts.  Those hidden entries are not for public consumption because 1) they are no longer relevant and 2) they are super emo entries.  Those were the days.

Anyway, I could've created a new blog, but I decided to retain this one since it was initially meant to chronicle my journey as a law student (hence the title).  The first post was in 2008, when I attended a review for UP LAE.  Fast forward to 2015, I am currently a student under the Juris Doctor Program of Laguna State Polytechnic University (LSPU).  A returning student at that, I was lost but now am found.

Today, in my ObliCon class, I was reminded of my purpose - why I wanted to become a lawyer in the first place.  It is because I want to serve my country well through the government.  I know it is still a long shot from here, but I believe that it was God who put that desire in my heart, and since then until now, he has been proving himself faithful.

For now, believe that you will get into law school.

This was written a few months back. I forgot when exactly, but this was the time when I felt so restless, broken. I felt the consequences of a love lost. I took the UP LAE and I was still waiting for the results.

God,
Help me. I am brokenhearted. Please silence my restless heart. Keep me focused and sensitive to your leading.


Know that I love you and only want the best for you. Be strong, revelation awaits an appointed time. I have for you majestic gifts that you can't imagine. Trust for I know what I do. Revelation awaits an appointed time, for it speaks of the end; it will not prove false. Though it may linger, wait for it. It will certainly come and will not delay. Be faithful and steadfast. Know what you are believing me for and I shall give it to you. NO promise will come back to me empty. One setp at a time. For now, believe that you will get into law school.

In the end, I did not pass the LAE, Buklod won in the elections, my powermemory biz is promising and my boss is the new DepEd Secretary.

Belt, Wallet, and Money Clip

My dad is back in Vietnam. This morning, I didn't go to work, I accompanied my mom to the airport to see him off. Yesterday, I bought him a new belt, wallet and money clip for his birthday on the 29th and it was my first time to shop in the men's accessories section.

Shopping is not my hobby actually. I only go to malls to buy something that I have seriously premeditated on. Some say that shopping for women is a form of relaxation and treatment, well, not for me. Although I love going to the spa and lavish myself with stuff from The Body Shop every once in awhile. Anyway, all I am saying is that I am no shopping expert, and so I find it relatively hard to choose from a variety of wallets and belts for men. They all looked the same to me. This is where brand names come in, after looking at different sales and brands, I settled with Hickok, only because that's the brand I know.

I bought a reversible belt and wallet from Hickok (I was amazed with the belt because my dad can use it for brown and black pants, just by turning the buckle around). I also went to McJim, I compared theirs and that of Hickok's, but I found Hickok's better and more affordable.

Of course, had I got more money to spend, I would have gone to Marlboro Classics or some place more expensive. But hey, I am really not particular about brands, only when I am clueless which to buy and only when nothing stands out. On the other hand, I don't mind spending much for my dad.

By the way, my dad was very happy when he saw what I bought him. He wore the belt with his flimsy shorts. hahaha

Dear Diary

Blogging appreciates my intrapersonal communication skills, and what's great about it is that no one finds it weird. When I tell my friends that I talk to myself and can actually finish a sentence for myself, they would either look at me with amusement on their faces or with pity. But then, the ability to commune with oneself is a rare privilege.

My Blogspot account serves as my haven, my hiding place for quiet times. When I want to "go out" and join the fun, I use my Multiply account. Before posting my first entry on Blogspot, I made a headcount of my friends who are also into the same provider, and I found out that most of the people I know who are into Blogspot belong to my circle of closest friends. I kinda like to keep this as a private place for myself, and if anybody finds out, then, kudos, cheers and welcome!

I grew up reading the Diary of Anne Frank, although I don't remember finishing it. My mom would always push me to read it as if it was the most enlightening book of all time. In fairness to my mom and to Anne, everytime I read her entries, I would always feel the connection between her words and my heart. I could feel her, and at some point, I thought I knew her.

I tried keeping a diary when I was young, but I didn't enjoy it. It seemed like I had to make a quota of entries or something everyday. It eventually became sort of a daily "academic" exercise because my mom told me that keeping a diary would help me track my progress in English and polish my grammar.
So, instead of just pouring out my emotions, I focused more on grammar, organizations and mechanics.

When I talk to myself, I also think that maybe someday someone would get to listen to my stories. Maybe someday too, someone would find out about my secret blogspot.

My Sweet Spot

I realized this morning how much I enjoy my job. I thought, "how many of us get to take part in implementing reforms in the Philippine Education system?" On the other hand, "how many of us care?" Perhaps, more than anything else, I enjoy being surrounded by my kindred spirits, and learning from them.

Frankly, I can't describe exactly what my job is. In our office, due to lack of manpower, we have to assume two or three responsibilities more in addition to our "designated" workload. I do technical, executive, writing, clerical, disbursements, and logistics, among others. Plus, I am now my boss' new best friend. hehe

I want to believe that I have found my "sweet spot" in here. Amidst the pressure I experience everyday, I am happy. Oh yeah, I am. It's funny how I tried to fit myself in other fields when I knew all along where I should be. In here, life is a breeze. No matter how overwhelming my work is, I can still say that I am having a really fun time.

Tongue-tied

Maybe it's just me or my personality, but I debunk the argument that women speak "something" thousand words a minute. I am a woman but I am no speed-talker. In fact I don't talk at all. I don't talk about my day and how it has been, about clothes, shoes, bags and stuff like that. Hmm.. I'm sure shy and coy girls would agree with me, but hey, I am no shy girl either! So, yeah, maybe it's just the personality...

I think I need to read a lot though... I sometimes find myself running out of good words to say. Gosh, I feel like speaking in tongues.

Toastmasters Club

I am set to attend my first Toastmasters Club Session on the 20th. I have been telling you about my thoughts on embracing spontaneity, and I guess speaking in front of people I don't know will really help me overcome whatever stage fright I have or any form of speech gaps I missed during my Speech Comm class..

The venue of the Toastmasters is at Sulo Hotel, which was actually my second choice after being ignored by the first one. But I guess, it turned out well and for the better.

Anyway, I am here in the office working -- on a holiday, on my mom's birthday, and in the middle of a heavy storm.

The Review

I attended a one whole day review program for the UP Law Aptitude Exam last Sunday. For a starter, we had to introduce ourselves and pick one question from a set of icebreaker questions. I really dread this getting-to-know-one-another part everytime I am in a big group, although I am guilty of the same crime.

When I was an Instructor at a University, I would ask my students to stand up and say something unique about themselves, sort of my way of remembering their names and faces,and also breaking the ice... I learned that in order to memorize effectively, I need to associate that which I need to memorize with something familiar. In my case, I would ask for something unique or weird about my students so I can easily remember them. It's easier to remember a cat wearing a yellow polka-dotted gown and dancing cha-cha over a stray gray cat.

Now, going back to my review class, while waiting for my turn, I was praying that God would give me a question that is so familiar. True enough, my turn came and my question read: "What do you want to achieve in life?" HA! I have been answering that my whole life, though my answers kept changing everytime. Without thinking, I told the class that I want to work for the government for the rest of my life. and the reason why I want to go to law school is because I think we're running out of good lawyers. And someday, I hope to be able to get in the Senate and uphold our Constitution, or perhaps change it. Naks! Mind you, I wasn't thinking then. Do I have to emphasize that one? I wasn't thinking.

I realized, there's really nothing much to say about myself. I am not spontaneous. In fact, right now, I'm practicing to write spontaneously. I just want to get used to spontaneity.

Anyway, the review was comprehensive, and it has been very helpful. I got a perfect score in almost all of the English exercises, though i flunked Math big time. as in 12/40. haha
